These Terms of Service ("Terms") govern your access to and use of the thestack.es platform at thestack.es (the "Service"), operated by thestack ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
thestack is a platform that helps you organise outreach and automate the sending of emails that you compose and configure yourself. You can write message templates, set recipients, and connect your own email account so that the Service sends messages on your behalf, at the times and to the recipients you specify.
You are solely responsible for the content of the messages you send through the Service and for the recipients you send them to. You agree that you will:
We may suspend or terminate accounts that violate these Terms or that put the Service, its users, or third parties at risk.
When you connect a Google or other email account, you authorise the Service to send messages on your behalf from that mailbox, as described in our Privacy Policy. You can disconnect a connected account at any time, which stops the Service from sending further messages from it. Your use of a connected account also remains subject to that provider's own terms.
Some features of the Service may require payment. Where fees apply, they will be described at the point of purchase. Except where required by law, fees are non-refundable.
The Service, including its software, design and content (excluding content you provide), is owned by thestack and protected by applicable laws. You retain ownership of the content you create, and you grant us the limited rights necessary to operate the Service and deliver your messages.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that every message will be delivered.
To the maximum extent permitted by law, thestack will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Provisions that by their nature should survive termination will do so.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Spain, without regard to its conflict-of-law rules, and the courts of Spain will have jurisdiction over any dispute, except where mandatory local law provides otherwise.
